With impeachment over, critics see Trump 'retribution tour'

Under the US Constitution, the president is the commander in chief of the armed forces, but Congress has the power to declare war. The spate of actions he's taken in the last week alone underscores the fresh sense of empowerment he feels after the Senate cleared him of abusing the power of his office - and has critics anxious he is dismantling the firewalls put up after President Richard Nixon's abuses of power.

"We want to make sure that any military action that needs to be authorized is in fact authorized properly by Congress", Republican Senator Mike Lee said. "That doesn't show weakness; that shows strength".

In June, another resolution that would have required Trump to get Congress' permission before striking Iran failed in the Senate. As Kaine says, "An offensive war requires a congressional debate and vote".

The principle of congressional approval is established for an important reason, Kaine said.


The U.S. House of Representatives passed two pieces of a legislation on January 30, seeking to limit Trump's authority to go to war with Iran.

"Well, it's a bad thing and, you know, I think of Nixon more than anybody else and what that dark period was in our country and the whole thing with the tapes and the horror show", Trump said.

In the almost two decades since the September 11, 2001, terrorist attacks, USA lawmakers have revisited the issue of congressional approval for conflicts with little success.

President Trump has already survived a House impeachment and Senate trial. At Republicans' request, he removed initial language that targeted Trump in favor of a generalized statement declaring that Congress has the sole power to declare war.


Trump attacked Kelly last October, after he said he had warned the president that hiring a "yes man" to replace him would lead to impeachment.
